Petition to Expand HSA/FSA Eligibility for Essential Women’s Health Products
We, the undersigned, urge the IRS to expand the scope of HSA/FSA-eligible expenses to include a broader range of essential women’s health products and services. These items support maternal health, reproductive care, and overall wellness, yet remain ineligible for tax-free reimbursement despite their clear medical necessity.
Women’s Health Deserves Equal Access to Tax-Free Healthcare Spending
Current HSA/FSA regulations exclude numerous products and services that play a vital role in women’s healthcare. We request the inclusion of the following essential items:
Maternity and Postpartum Care: Nursing bras, lactation massagers, breastfeeding shirts/tops, postpartum meals, and expanded coverage for birthing and breastfeeding classes. These items directly support maternal health and infant nutrition.
Reproductive Health & Fertility Support: Fertility coaching, birthing coach/doula services, egg donor and egg recipient fees, and cord blood storage. These services provide critical support for women navigating fertility, pregnancy, and childbirth.
Pelvic and Sexual Health: Pelvic floor trainers, vaginal moisturizers and hydrating gels, pH-balancing feminine wash, probiotics, and sexual health devices. These products are essential for postpartum recovery, menopause support, and overall pelvic health.
Essential Nutritional Support: Post-natal vitamins and iron supplements, which are often medically recommended but remain ineligible without a prescription.
Aligning Policy with Women’s Healthcare Needs
The exclusion of these products and services creates a gender gap in healthcare tax benefits. The CARES Act of 2020 recognized the necessity of menstrual products, making them HSA/FSA eligible. It is time to take the next step in ensuring comprehensive coverage for women's health by recognizing these medically necessary expenses.

We urge the IRS to update HSA/FSA guidelines to reflect the evolving needs of women’s healthcare. Expanding eligibility for these products will improve health outcomes and provide much-needed financial relief for millions of women across the country.
